Last updated: November 4, 2026
This document is also available in Portuguese. For customers in Brazil, the Portuguese version prevails in case of conflict.
1. Who we are
These Terms of Service ("Terms") govern access to and use of the AI Process Automation software (the "Service"), available at https://evercene.com.br/en/automation, developed and operated by Evercene Tecnologia LTDA, registered in Brazil under CNPJ 69.646.489/0001-70, with its registered address at Av. Paulista, 91, Bela Vista, São Paulo/SP, CEP 01.311-000, Brazil ("we", "us", the "Company"). Contact: suporte@evercene.com.br · +55 19 99673-3766.
By creating an account, subscribing to a plan or using the Service, you ("Customer") confirm that you have read and accept these Terms, our Privacy Policy (https://evercene.com.br/en/automation/privacy) and our Refund Policy (https://evercene.com.br/en/automation/refund). If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
2. The Service
AI Process Automation is a software-as-a-service (SaaS) platform that lets you create, configure and run artificial-intelligence agents that automate business tasks, such as organizing and extracting data, triaging requests, drafting content, summaries and reports, and executing workflows in connected tools, including through scheduled recurring automations. Features available on each plan are described on our Pricing (https://evercene.com.br/en/automation/pricing) page.
3. Account
You must be at least 18 years old and legally capable, provide accurate information, and keep your credentials confidential. You are responsible for all activity under your account and must notify us promptly of any unauthorized use.
4. Reseller and Merchant of Record (Paddle)
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
When you purchase, you also enter into an agreement with Paddle under the Paddle Buyer Terms available at paddle.com/legal. Paddle handles checkout, billing, calculation and remittance of applicable taxes, and issues receipts/invoices. We do not store your full payment card details.
5. Subscriptions, payment and renewal
5.1. The Service is offered on a subscription basis under the plans and prices shown on our Pricing (https://evercene.com.br/en/automation/pricing) page — Starter (US$100/month or US$1,000/year), Essential (US$400/month or US$4,000/year) and Ultra (US$600/month or US$6,000/year), in US dollars (USD) — billed monthly or annually in advance. Each plan has limits on the number of automations and on run frequency, as described on the Pricing page.
5.2. Automatic renewal: your subscription renews automatically at the end of each billing period for the same term, and Paddle will charge your payment method on file unless you cancel before the renewal date.
5.3. Price changes: we may change prices with at least 30 days' notice by email; changes apply from your next renewal. If you disagree, you may cancel before renewal.
5.4. Upgrades and downgrades may result in prorated charges or credits as calculated by Paddle at checkout.
5.5. Applicable taxes may be added at checkout depending on your location.
5.6. If a payment fails, we may suspend access until payment is made.
6. Cancellation
You may cancel at any time from your account dashboard, through the "Manage subscription" link in your Paddle receipt email, via paddle.net, or by emailing suporte@evercene.com.br. Cancellation stops future charges and takes effect at the end of the current paid period, during which your access remains active. Refunds are governed by our Refund Policy (https://evercene.com.br/en/automation/refund).
7. Acceptable use
You agree not to use the Service to:
- send spam, bulk or mass messages, or unsolicited messages through any channel (email, SMS, messaging apps or otherwise), or contact people who have not consented to receive your messages;
- violate any law (including data-protection, consumer-protection and advertising laws) or third-party rights (privacy, intellectual property, publicity);
- engage in fraud, phishing, scams, harassment or discrimination, or distribute illegal, deceptive, defamatory, violent content or any sexual content involving minors;
- collect or process personal data without a lawful basis, or process sensitive data without required safeguards;
- make high-impact automated decisions (credit, employment, health, legal) without qualified human review;
- distribute malware, circumvent technical or security limits, reverse engineer, resell or sublicense the Service without authorization;
- overload our infrastructure or violate the terms of AI providers or connected platforms.
We may suspend or terminate accounts that breach this section, with or without notice where necessary to protect the Service or third parties or to comply with law.
8. Customer Content
You retain ownership of the data, files and instructions you submit ("Customer Content") and grant us a limited license to process it solely to provide, maintain and secure the Service. You represent that you hold the necessary rights and legal bases for that content. Customer Content is not used to train or retrain AI models — neither by us nor by any AI provider we use.
9. AI-generated output
The Service uses artificial-intelligence models, including from third-party providers. Outputs may be inaccurate, incomplete, outdated or inappropriate, and similar outputs may be generated for other users. You are responsible for reviewing outputs before using them, for enabling human approval where appropriate, and for the actions agents take on your behalf in tools you connect. Outputs are not professional (legal, financial, medical or other) advice.
10. Third-party services
The Service may integrate with third-party tools (including AI providers Anthropic, OpenAI and SpaceXAI and platforms you connect). Your use of them is subject to their terms, and we are not responsible for their availability, changes or conduct.
11. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance and change features, and will try to give advance notice of material changes that reduce paid-plan functionality.
12. Intellectual property
The software, the Evercene brand, the AI Process Automation name, design and documentation belong to the Company or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription in accordance with these Terms.
13. Personal data
Our processing of personal data is described in our Privacy Policy (https://evercene.com.br/en/automation/privacy). Where the Customer submits personal data of third parties (e.g., its own customers) to the Service, the Customer acts as controller and the Company as processor, processing such data only on the Customer's instructions and to provide the Service. A Data Processing Agreement (DPA) is available on request at privacidade@evercene.com.br.
14. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of fitness for a particular purpose, business results or accuracy of outputs.
15. Limitation of liability
To the maximum extent permitted by applicable law: (a) the Company is not liable for lost profits, revenue, data or opportunities, or for indirect, incidental or consequential damages; (b) the Company is not liable for decisions or actions taken based on AI outputs, or for actions executed by agents as configured by the Customer; (c) the Company is not liable for acts of third parties, including AI providers and connected platforms; and (d) the Company's total liability is limited to the amount paid by the Customer for the Service in the 12 months preceding the event. Nothing in these Terms limits non-waivable consumer rights under applicable law (including the Brazilian Consumer Protection Code, Law No. 8,078/1990) or liability for willful misconduct or gross negligence.
16. Indemnification
The Customer will indemnify the Company against third-party claims arising from breach of these Terms or the law, or misuse of the Service.
17. Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment or legal requirement. After termination, you may request an export of your data within 30 days, after which it may be deleted in accordance with our Privacy Policy.
18. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in the Service at least 15 days in advance. Continued use after the effective date means acceptance; if you disagree, you may cancel.
19. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP, Brazil, have jurisdiction, without prejudice to a consumer's right to bring proceedings in the courts of their domicile or to mandatory consumer protections of their country of residence. Purchases, billing and refunds are also subject to Paddle's terms.
